Ticaret ve sanayinin daha yo\u011fun oldu\u011fu b\u00f6lgelerde istihdam g\u00fcc\u00fcn\u00fcn daha fazla olmas\u0131 nedeni ile i\u015f hukukundan kaynakl\u0131 uyu\u015fmazl\u0131k ve dava say\u0131s\u0131 daha fazlad\u0131r. \u0130\u015f Hukuku ile ilgili d\u00fczenlemeler 4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nda d\u00fczenlenmi\u015ftir fakat 4857 Say\u0131l\u0131 \u0130\u015f Kanunu t\u00fcm i\u015f\u00e7ileri kapsamamakla birlikte \u00e7al\u0131\u015fan kesimin b\u00fcy\u00fck bir k\u0131sm\u0131 4857 Say\u0131l\u0131 \u0130\u015f Kanunu\u2019na tabidir. \u0130\u015f Hukuku kapsaml\u0131 ve uzmanl\u0131k gerektiren hukuk dallar\u0131ndan biridir. \u0130\u015f Hukuku alan\u0131nda Erzurum\u2019da faaliyet g\u00f6steren hukuk b\u00fcromuz i\u015f\u00e7i ve i\u015fveren vekili olarak i\u015f hukukundan kaynaklanan t\u00fcm dava t\u00fcrlerinde dan\u0131\u015fmanl\u0131k ve taraf vekilli\u011fi yapmaktad\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0130\u015f Hukukundan do\u011fan bir\u00e7ok ihtilaf 4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nda a\u00e7\u0131k\u00e7a d\u00fczenlenmi\u015ftir fakat \u00e7al\u0131\u015fma hayat\u0131 i\u00e7erisinde i\u015f\u00e7i ve i\u015fverenler sahip oldu\u011fu \u00e7o\u011fu hak ve y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc bilmemektedir bu durum hem i\u015f yerinde \u00e7al\u0131\u015f\u0131rken hemde i\u015f yerinden ayr\u0131ld\u0131ktan sonra bir \u00e7ok hak kayb\u0131na neden olmaktad\u0131r bu nedenle i\u015f hukuku yaln\u0131zca i\u015f s\u00f6zle\u015fmesi sona erdikten sonra de\u011fil i\u015f s\u00f6zle\u015fmesi devam ederken de bir \u00e7ok uyu\u015fmazl\u0131kta uygulanmaktad\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Erzurum \u0130\u015f Kazas\u0131<\/strong><br>\u00c7al\u0131\u015fma hayat\u0131 i\u00e7erisinde i\u015f\u00e7i i\u015fveren uyu\u015fmazl\u0131klar\u0131 genellikle i\u015f\u00e7i aleyhine sonu\u00e7 do\u011furmaktad\u0131r bunun \u00f6n\u00fcne ge\u00e7ilmesi i\u00e7in \u00f6zellikle i\u015fveren taraf\u0131ndan i\u015f\u00e7inin keyfi olarak i\u015ften \u00e7\u0131kart\u0131lmas\u0131n\u0131n \u00f6n\u00fcne ge\u00e7ilmesi i\u00e7in i\u015f g\u00fcvencesi hakk\u0131 sa\u011flanarak i\u015f\u00e7ilerin keyfi olarak i\u015ften \u00e7\u0131kar\u0131lmas\u0131 halinde i\u015fe iade davas\u0131 a\u00e7\u0131larak i\u015f\u00e7inin i\u015fe geri al\u0131nmas\u0131 geri al\u0131nmamas\u0131 halinde i\u015fveren tazminat \u00f6demesi kanunla belirlenmi\u015ftir bunun d\u0131\u015f\u0131nda \u015fartlar\u0131n sa\u011flanmamas\u0131 nedeni ile \u0130\u015f g\u00fcvencesinden yararlanamayan i\u015f\u00e7ilerinde haks\u0131z ve k\u00f6t\u00fc niyetli olarak i\u015ften \u00e7\u0131kart\u0131lmas\u0131 halinde k\u00f6t\u00fc niyet tazminat talep hakk\u0131 d\u00fczenlenmi\u015ftir. \u0130\u015f hukuku geni\u015f ve kapsaml\u0131 d\u00fczenlemeleri ile i\u015f\u00e7i ve i\u015fverenlerin hak ve y\u00fck\u00fcml\u00fcl\u00fcklerini belirlemektedir bu alanda \u00e7al\u0131\u015fan avukatlara da halk s\u00f6ylemi ile i\u015f\u00e7i avukat\u0131 ve i\u015f hukuku avukat\u0131 denilmektedir genellikle i\u015f hukuku alan\u0131nda \u00e7al\u0131\u015fan avukatlar i\u015f\u00e7i ve i\u015fveren vekilli\u011fi yaparak i\u015f hukukundan do\u011fan ihtilaflar\u0131n \u00e7\u00f6z\u00fcm\u00fcnde rol oynamaktad\u0131rlar. \u0130\u015f\u00e7i ve i\u015fverenlere ili\u015fkin d\u00fczenlemelerin yaln\u0131zca 4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nda yer almamaktad\u0131r i\u015f\u00e7i olup 4857 say\u0131l\u0131 \u0130\u015f Kanununa tabi olmayan i\u015f\u00e7iler i\u00e7in Bas\u0131n \u0130\u015f Kanunu ,Deniz \u0130\u015f Kanunu gibi hak ve y\u00fck\u00fcml\u00fcl\u00fcklerinin d\u00fczenledi\u011fi kanunlar bulunmaktad\u0131r bunun d\u0131\u015f\u0131nda i\u015f kazas\u0131 meslek hastal\u0131\u011f\u0131 meydana gelmesi halinde i\u015f\u00e7inin haklar\u0131n\u0131 d\u00fczenleyen 5510 Say\u0131l\u0131 Kanun, 6331 Say\u0131l\u0131 \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kanunu bulunmaktad\u0131r bu nedenle i\u015f\u00e7i ve i\u015fveren meydana gelen uyu\u015fmazl\u0131klarda uyu\u015fmazl\u0131\u011f\u0131n yarg\u0131 \u00f6n\u00fcne gitmeden alan\u0131ndan uzman bir avukata dan\u0131\u015fmas\u0131 yarg\u0131 yoluna gidilmi\u015f uyu\u015fmazl\u0131kta vekil ile temsil edinilmesi son derece \u00f6nemli bir husustur. \u0130\u015f Mahkemelerinde a\u00e7\u0131lan davalar Hukuk davas\u0131 niteli\u011finde oldu\u011funda uygulanacak h\u00fck\u00fcmler Hukuk Muhakemeleri Kanunu\u2019nda d\u00fczenlenmektedir bu nedenle i\u015f mahkemelerinde a\u00e7\u0131lan davalarda davan\u0131n seyrini etkileyen usul kurallar\u0131 bulunmaktad\u0131r bu nedenle i\u015f\u00e7i veya i\u015fveren taraf\u0131ndan dava a\u00e7madan \u00f6nce uzman bir avukata dan\u0131\u015f\u0131lmal\u0131d\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0130\u015f Mahkemelerinde g\u00f6r\u00fclen davalar kural olarak Arabuluculuk \u015fart\u0131na tabidir. \u0130\u015f\u00e7inin arabuluculuk yoluna ba\u015fvurmadan dava a\u00e7mas\u0131 halinde dava usulden reddedilecektir. Arabuluculu\u011fa tabi i\u015f\u00e7ilik alacaklar\u0131 i\u015fe iade gibi davalarda dava a\u00e7madan \u00f6nce arabuluculuk yoluna ba\u015fvurma zorunlulu\u011fu unutulmamal\u0131d\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u0130\u015f Hukuku Avukat\u0131 Ne \u0130\u015f Yapar?<\/strong><br>\u00c7al\u0131\u015fma hayat\u0131 i\u00e7erisinde i\u015f\u00e7iler ile i\u015fveren aras\u0131ndaki ihtilaflar\u0131n \u00e7\u00f6z\u00fcm\u00fcnde ve bu alanda \u00e7al\u0131\u015fan avukatlara i\u015f hukuku avukat\u0131, i\u015f\u00e7i avukat\u0131 veya i\u015fveren avukat\u0131 denir. Hukukumuzda avukatl\u0131kta bran\u015fla\u015fma zorunlulu\u011fu bulunmamaktad\u0131r fakat genel olarak belirli bir hukuk dal\u0131nda faaliyet g\u00f6steren avukatlar bu \u015fekilde adland\u0131r\u0131labilmektedirler.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0130\u015f Hukuku avukat\u0131 olarak faaliyet g\u00f6sterdi\u011fimiz dava t\u00fcrleri \u015funlard\u0131r:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>1.1.1 \u0130\u015f\u00e7i Alaca\u011f\u0131 Davas\u0131<\/strong><br>\u0130\u015f\u00e7i alaca\u011f\u0131 davas\u0131 i\u015f akdinin feshinden sonra a\u00e7\u0131labildi\u011fi gibi , i\u015f s\u00f6zle\u015fmesi devam ederken i\u015f\u00e7inin dava a\u00e7abilece\u011fi alacaklar\u0131 bulunabilmektedir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">K\u0131dem tazminat\u0131 , ihbar tazminat\u0131 i\u015f akdi sona ermeden i\u015f\u00e7i alaca\u011f\u0131 davas\u0131 a\u00e7\u0131lamamaktad\u0131r. Fakat fazla mesai \u00fccreti, hafta tatili \u00fccreti, Ulusal Bayram genel tatil \u00fccreti feshe ba\u011fl\u0131 olmayan i\u015f\u00e7i alacaklar\u0131 i\u015f\u00e7i i\u015ften \u00e7\u0131kmadan da a\u00e7abilmektedir.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><strong>1.1.2 K\u0131dem Tazminat\u0131 Alaca\u011f\u0131 Davas\u0131<\/strong><br>\u0130\u015f\u00e7inin k\u0131dem tazminat\u0131na hak kazanabilmesinin ilk \u015fart\u0131 i\u015f yerinde kesintisiz olarak bir y\u0131l ve \u00fczerinde \u00e7al\u0131\u015fm\u0131\u015f olmas\u0131d\u0131r. 1 y\u0131l \u015fart\u0131n\u0131 sa\u011flayan i\u015f\u00e7iler i\u015fveren taraf\u0131ndan hakl\u0131 nedenle fesih hali hari\u00e7 olmak \u00fczere herhangi bir sebeple i\u015ften \u00e7\u0131kar\u0131lmas\u0131 veya i\u015f\u00e7inin hakl\u0131 ve ge\u00e7erli nedenle i\u015f akdini feshetme zorunlulu\u011fu olmas\u0131 halinde k\u0131dem tazminat\u0131na hak kazanabilecektir. Ayr\u0131ca k\u0131dem tazminat\u0131na hak kazanman\u0131n di\u011fer halleri 1475 say\u0131l\u0131 kanunun y\u00fcr\u00fcrl\u00fckte bulunan 14 . Maddesi gere\u011fi ;Muvazzaf askerlik hizmeti dolay\u0131s\u0131 ile, ba\u011fl\u0131 bulunduklar\u0131 kanunla veya Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamesiyle kurulu kurum veya sand\u0131klardan ya\u015fl\u0131l\u0131k, emeklilik veya malull\u00fck ayl\u0131\u011f\u0131 yahut toptan \u00f6deme almak amac\u0131yla; ya\u015fl\u0131l\u0131k ayl\u0131\u011f\u0131 ba\u011flanmas\u0131 i\u00e7in \u00f6ng\u00f6r\u00fclen sigortal\u0131l\u0131k s\u00fcresini ve prim \u00f6deme g\u00fcn say\u0131s\u0131n\u0131 tamamlayarak kendi istekleri ile i\u015ften ayr\u0131lmalar\u0131 nedeniyle, Feshedilmesi veya kad\u0131n\u0131n evlendi\u011fi tarihten itibaren bir y\u0131l i\u00e7erisinde kendi arzusu ile sona erdirmesi veya i\u015f\u00e7inin \u00f6l\u00fcm\u00fc sebebiyle son bulmas\u0131 hallerinde i\u015f\u00e7inin i\u015fe ba\u015flad\u0131\u011f\u0131 tarihten itibaren hizmet aktinin devam\u0131 s\u00fcresince her ge\u00e7en tam y\u0131l i\u00e7in i\u015fverence i\u015f\u00e7iye 30 g\u00fcnl\u00fck \u00fccreti tutar\u0131nda k\u0131dem tazminat\u0131 \u00f6denir. Bir y\u0131ldan artan s\u00fcreler i\u00e7in de ayn\u0131 oran \u00fczerinden \u00f6deme yap\u0131l\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>1.1.3 \u0130hbar Tazminat\u0131 Alaca\u011f\u0131 Davas\u0131<\/strong><br>4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 17. Maddesine ayk\u0131r\u0131 olarak bildirim s\u00fcresine uyulmaks\u0131z\u0131n i\u015f akdinin feshedilmesi halinde do\u011fan alacakt\u0131r. Buna g\u00f6re \u0130\u015f s\u00f6zle\u015fmeleri;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0130\u015fi alt\u0131 aydan az s\u00fcrm\u00fc\u015f olan i\u015f\u00e7i i\u00e7in, bildirimin di\u011fer tarafa yap\u0131lmas\u0131ndan ba\u015flayarak iki hafta sonra,<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0130\u015fi alt\u0131 aydan bir bu\u00e7uk y\u0131la kadar s\u00fcrm\u00fc\u015f olan i\u015f\u00e7i i\u00e7in, bildirimin di\u011fer tarafa yap\u0131lmas\u0131ndan ba\u015flayarak d\u00f6rt hafta sonra,<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0130\u015fi bir bu\u00e7uk y\u0131ldan \u00fc\u00e7 y\u0131la kadar s\u00fcrm\u00fc\u015f olan i\u015f\u00e7i i\u00e7in, bildirimin di\u011fer tarafa yap\u0131lmas\u0131ndan ba\u015flayarak alt\u0131 hafta sonra,<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0130\u015fi \u00fc\u00e7 y\u0131ldan fazla s\u00fcrm\u00fc\u015f i\u015f\u00e7i i\u00e7in, bildirim yap\u0131lmas\u0131ndan ba\u015flayarak sekiz hafta sonra,<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Feshedilmi\u015f say\u0131l\u0131r. Bu s\u00fcreler asgari olup s\u00f6zle\u015fmeler ile art\u0131r\u0131labilir. Bildirim \u015fart\u0131na uymayan taraf, bildirim s\u00fcresine ili\u015fkin \u00fccret tutar\u0131nda tazminat \u00f6demek zorundad\u0131r. G\u00f6r\u00fclece\u011fi \u00fczere hakl\u0131 nedenle derhal fesih halleri sakl\u0131 kalmak kayd\u0131 ile i\u015f\u00e7i veya i\u015fveren taraf\u0131ndan i\u015f akdinin bildirim s\u00fcrelerine uyulmaks\u0131z\u0131n feshi halinde yukar\u0131da yaz\u0131l\u0131 tutarlar tazminat olarak bildirim s\u00fcresine uymayan taraf\u00e7a \u00f6denmektedir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">1<strong>.1.4 Ulusal Bayram Genel Tatil Alaca\u011f\u0131 Davas\u0131<\/strong><br>\u0130\u015f\u00e7inin Ulusal Bayram Genel Tatil g\u00fcnlerinde \u00e7al\u0131\u015fmas\u0131 olmas\u0131na kar\u015f\u0131n bu g\u00fcnlerin \u00fccreti i\u015fveren taraf\u0131ndan \u00f6denmemesi halinde i\u015f\u00e7inin i\u015f yerinde \u00e7al\u0131\u015fmaya devam ederken ve i\u015ften \u00e7\u0131kt\u0131ktan sonra a\u00e7\u0131lan davad\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>1.1.5 Y\u0131ll\u0131k \u0130zin Alaca\u011f\u0131 Davas\u0131<\/strong><br>\u0130\u015f\u00e7inin \u00e7al\u0131\u015ft\u0131\u011f\u0131 s\u00fcre boyunca y\u0131ll\u0131k izin hakk\u0131n\u0131n kulland\u0131r\u0131lmam\u0131\u015f olmas\u0131 halinde i\u015ften \u00e7\u0131kt\u0131ktan sonra kullan\u0131lmayan y\u0131ll\u0131k izin g\u00fcnlerine ili\u015fkin \u00fccretinin talebi ile a\u00e7\u0131lan davaya y\u0131ll\u0131k izin \u00fccreti alaca\u011f\u0131 davas\u0131 denilmektedir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>1.1.6 Hafta Tatili Alaca\u011f\u0131 Davas\u0131<\/strong><br>\u0130\u015f\u00e7inin yedi g\u00fcnl\u00fck bir zaman dilimi i\u00e7inde kesintisiz en az yirmid\u00f6rt saat dinlenme (hafta tatili) verilmesi kanunen zorunludur. Bu iznin verilmemesi ve i\u015f\u00e7inin hafta tatili g\u00fcnlerinde de \u00e7al\u0131\u015fmas\u0131 halinde yani i\u015f\u00e7inin 7 g\u00fcn boyunca kesintisiz \u00e7al\u0131\u015ft\u0131\u011f\u0131 hallerde a\u00e7\u0131lan davaya hafta tatili alaca\u011f\u0131 davas\u0131 denilmektedir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>1.2 \u0130\u015fe \u0130ade Davas\u0131<\/strong><br>Kanunun i\u015fe iade davas\u0131 ile i\u015f\u00e7iye sa\u011flad\u0131\u011f\u0131 fayda i\u015fveren taraf\u0131ndan i\u015f\u00e7inin keyfi i\u015ften \u00e7\u0131kar\u0131lmas\u0131n\u0131 engellemektir. Bu nedenle i\u015f\u00e7inin i\u015fveren taraf\u0131ndan keyfi olarak i\u015ften \u00e7\u0131kar\u0131lmas\u0131 halinde a\u00e7\u0131lacak dava i\u015fe iade davas\u0131d\u0131r. \u0130\u015fe iade davas\u0131n\u0131n kanunda yaz\u0131l\u0131 bir tak\u0131m \u015fartlar\u0131 ve dava a\u00e7ma s\u00fcreleri bulunmaktad\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>1.3 K\u00f6t\u00fc Niyet Tazminat\u0131 Davas\u0131<\/strong><br>\u0130\u015f\u00e7inin i\u015fe iade davas\u0131 \u015fartlar\u0131n\u0131 sa\u011flamad\u0131\u011f\u0131 yani i\u015f g\u00fcvencesinden faydalanamad\u0131\u011f\u0131 hallerde a\u00e7\u0131lan dava ile i\u015f\u00e7iler i\u015fveren taraf\u0131ndan k\u00f6t\u00fc niyetli yap\u0131lan fesihlerde k\u00f6t\u00fc niyet tazminat\u0131 talep edebilmektedir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>1.4 Sigortal\u0131l\u0131\u011f\u0131n Tespiti \u2013 Hizmet Tespiti Davalar\u0131<\/strong><br>\u0130\u015f\u00e7ilerin \u00e7al\u0131\u015ft\u0131\u011f\u0131 s\u00fcre boyunca sigortal\u0131l\u0131klar\u0131n\u0131n bildirilmemesi halinde yani i\u015f\u00e7inin sigortas\u0131z olarak \u00e7al\u0131\u015fmas\u0131 halinde a\u00e7\u0131lan dava Sigortal\u0131l\u0131\u011f\u0131n tespiti davas\u0131d\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>1.5 \u0130\u015f kazas\u0131 Nedeni \u0130le Maddi \u2013 Manevi Tazminat Davas\u0131<\/strong><br>\u0130\u015f\u00e7inin i\u015f kazas\u0131 ge\u00e7irmesi nedeni ile a\u00e7\u0131lacak bir \u00e7ok dava olup i\u015f kazas\u0131 nedeni ile maddi tazminat, i\u015f kazas\u0131 nedeni ile manevi tazminat , i\u015f kazas\u0131 neticesinde vefat ger\u00e7ekle\u015fmi\u015f ise i\u015f\u00e7inin miras\u00e7\u0131lar\u0131 taraf\u0131ndan a\u00e7\u0131lacak maddi manevi tazminat i\u015f kazas\u0131 halinde a\u00e7\u0131lan ba\u015fl\u0131ca davalardand\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>1.6 Meslek Hastal\u0131\u011f\u0131 Nedeni \u0130le Maddi \u2013 Manevi Tazminat Davas\u0131<\/strong><br>5510 say\u0131l\u0131 kanunun 14. Maddesinde Meslek hastal\u0131\u011f\u0131, sigortal\u0131n\u0131n \u00e7al\u0131\u015ft\u0131\u011f\u0131 veya yapt\u0131\u011f\u0131 i\u015fin niteli\u011finden dolay\u0131 tekrarlanan bir sebeple veya i\u015fin y\u00fcr\u00fct\u00fcm \u015fartlar\u0131 y\u00fcz\u00fcnden u\u011frad\u0131\u011f\u0131 ge\u00e7ici veya s\u00fcrekli hastal\u0131k, bedensel veya ruhsal engellilik h\u00e2lleridir \u015feklinde tan\u0131mlanm\u0131\u015ft\u0131r .6331 say\u0131l\u0131 \u0130\u015f sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kanununda meslek hastal\u0131\u011f\u0131 mesleki risklere maruziyet sonucu ortaya \u00e7\u0131kan hastal\u0131k olarak tan\u0131mlanm\u0131\u015ft\u0131r. \u0130\u015f\u00e7inin meslek hastal\u0131\u011f\u0131na yakalanmas\u0131 halinde i\u015fveren durumu Sosyal G\u00fcvenlik Kurumuna bildirir ve tahkikat ba\u015flar i\u015fveren taraf\u0131ndan meslek hastal\u0131\u011f\u0131 Sosyal G\u00fcvenlik Kurumuna bildirilmez ise i\u015f\u00e7i taraf\u0131ndan bildirilmesi gerekmektedir. Meslek hastal\u0131\u011f\u0131 nedeniyle i\u015fverene kar\u015f\u0131 a\u00e7\u0131lacak dava t\u00fcrlerinden ba\u015fl\u0131cas\u0131 maddi manevi tazminat davas\u0131d\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>1.7 Sigortal\u0131l\u0131\u011f\u0131n \u0130ptali Nedeni \u0130le Kurum \u0130\u015fleminin \u0130ptali Davas\u0131<\/strong><br>\u0130\u015f\u00e7inin sigorta primlerinin Sosyal G\u00fcvenlik Kurumu taraf\u0131ndan ger\u00e7ek \u00e7al\u0131\u015fmaya ba\u011fl\u0131 olmad\u0131\u011f\u0131 gerek\u00e7esi ya\u015fl\u0131l\u0131k ayl\u0131\u011f\u0131n\u0131n iptali halinde Sosyal G\u00fcvenlik Kurumu\u2019na kar\u015f\u0131 kurum i\u015fleminin iptali davas\u0131 a\u00e7\u0131lmaktad\u0131r. Bu davada g\u00f6revli mahkeme i\u015f mahkemesidir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u0130\u015f Davalar\u0131nda Arabuluculuk \u015eart M\u0131 ?<\/strong><br>\u0130\u015f Mahkemelerinde a\u00e7\u0131lacak i\u015f\u00e7i i\u015fveren aras\u0131ndaki uyu\u015fmazl\u0131klarda dava a\u00e7madan \u00f6nce arabuluculu\u011fa ba\u015fvurmak zorunludur. Bu \u015fart\u0131n yerine getirilmemesi halinde dava usulden reddedilecektir. 7036 say\u0131l\u0131 \u0130\u015f Mahkemeleri Kanunu\u2019nun \u00fc\u00e7\u00fcnc\u00fc Maddesinde arabuluculuk \u015fart\u0131n\u0131n zorunlu oldu\u011fu dava t\u00fcrleri Kanuna, bireysel veya toplu i\u015f s\u00f6zle\u015fmesine dayanan i\u015f\u00e7i veya i\u015fveren alaca\u011f\u0131 ve tazminat\u0131 ile i\u015fe iade talebiyle a\u00e7\u0131lan davalarda, arabulucuya ba\u015fvurulmu\u015f olmas\u0131 dava \u015fart\u0131d\u0131r olarak belirlenmi\u015ftir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Hangi \u0130\u015f Davalar\u0131nda Arabuluculuk Zorunlu?<\/strong><br>7036 say\u0131l\u0131 \u0130\u015f Mahkemeleri Kanunu\u2019nun \u00fc\u00e7\u00fcnc\u00fc Maddesi gere\u011fi arabuluculuk \u015fart\u0131n\u0131n zorunlu oldu\u011fu dava t\u00fcrleri Kanuna, bireysel veya toplu i\u015f s\u00f6zle\u015fmesine dayanan i\u015f\u00e7i veya i\u015fveren alaca\u011f\u0131 ve tazminat\u0131 ile i\u015fe iade talebiyle a\u00e7\u0131lan davalarda, arabulucuya ba\u015fvurulmu\u015f olmas\u0131 dava \u015fart\u0131d\u0131r olarak belirlenmi\u015ftir. Bu nedenle i\u015f\u00e7i alaca\u011f\u0131, i\u015fveren alaca\u011f\u0131 ve i\u015f\u00e7i i\u015fveren ili\u015fkisinden do\u011fan tazminat davalar\u0131 ve i\u015fe iade davalar\u0131nda dava a\u00e7madan \u00f6nce arabuluculu\u011fa ba\u015fvuru zorunludur.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u0130\u015f\u00e7i \u0130\u015fveren Arabuluculuk \u00dccretini Kim \u00d6der?<\/strong><br>7036 say\u0131l\u0131 kanunun \u00fc\u00e7\u00fcnc\u00fc maddesinin on \u00fc\u00e7 on d\u00f6rt on be\u015f ve on alt\u0131nc\u0131 f\u0131kralar\u0131nda arabuluculuk \u00fccretinin kim taraf\u0131ndan \u00f6denece\u011fi d\u00fczenlenmi\u015ftir. Buna g\u00f6re arabuluculukta anla\u015fma olmas\u0131 halinde arabuluculuk \u00fccreti aksi taraflarca kararla\u015ft\u0131r\u0131lmad\u0131k\u00e7a anla\u015f\u0131lan miktar \u00fczerinden Arabuluculuk \u00dccret Tarifesinin \u0130kinci K\u0131sm\u0131na g\u00f6re taraflarca e\u015fit olarak \u00f6denir, anla\u015fma sa\u011flanmamas\u0131 halinde ileride haks\u0131z \u00e7\u0131kacak taraftan tahsil edilmek \u00fczere Adalet Bakanl\u0131\u011f\u0131 b\u00fct\u00e7esinden \u00f6denmektedir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(13) Taraflar\u0131n arabuluculuk faaliyeti sonunda anla\u015fmalar\u0131 h\u00e2linde, arabuluculuk \u00fccreti, Arabuluculuk Asgari \u00dccret Tarifesinin eki Arabuluculuk \u00dccret Tarifesinin \u0130kinci K\u0131sm\u0131na g\u00f6re aksi kararla\u015ft\u0131r\u0131lmad\u0131k\u00e7a taraflarca e\u015fit \u015fekilde kar\u015f\u0131lan\u0131r. Bu durumda \u00fccret, Tarifenin Birinci k\u0131sm\u0131nda belirlenen iki saatlik \u00fccret tutar\u0131ndan az olamaz. \u0130\u015fe iade talebiyle yap\u0131lan g\u00f6r\u00fc\u015fmelerde taraflar\u0131n anla\u015fmalar\u0131 durumunda, arabulucuya \u00f6denecek \u00fccretin belirlenmesinde i\u015f\u00e7iye i\u015fe ba\u015flat\u0131lmamas\u0131 h\u00e2linde \u00f6denecek tazminat miktar\u0131 ile \u00e7al\u0131\u015ft\u0131r\u0131lmad\u0131\u011f\u0131 s\u00fcre i\u00e7in \u00f6denecek \u00fccret ve di\u011fer haklar\u0131n\u0131n toplam\u0131, Tarifenin \u0130kinci K\u0131sm\u0131 uyar\u0131nca \u00fczerinde anla\u015f\u0131lan miktar olarak kabul edilir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(14) Arabuluculuk faaliyeti sonunda taraflara ula\u015f\u0131lamamas\u0131, taraflar kat\u0131lmad\u0131\u011f\u0131 i\u00e7in g\u00f6r\u00fc\u015fme yap\u0131lamamas\u0131 veya iki saatten az s\u00fcren g\u00f6r\u00fc\u015fmeler sonunda taraflar\u0131n anla\u015famamalar\u0131 h\u00e2llerinde, iki saatlik \u00fccret tutar\u0131 Tarifenin Birinci K\u0131sm\u0131na g\u00f6re Adalet Bakanl\u0131\u011f\u0131 b\u00fct\u00e7esinden \u00f6denir. \u0130ki saatten fazla s\u00fcren g\u00f6r\u00fc\u015fmeler sonunda taraflar\u0131n anla\u015famamalar\u0131 h\u00e2linde ise iki saati a\u015fan k\u0131sma ili\u015fkin \u00fccret aksi kararla\u015ft\u0131r\u0131lmad\u0131k\u00e7a taraflarca e\u015fit \u015fekilde Tarifenin Birinci K\u0131sm\u0131na g\u00f6re kar\u015f\u0131lan\u0131r. Adalet Bakanl\u0131\u011f\u0131 b\u00fct\u00e7esinden \u00f6denen ve taraflarca kar\u015f\u0131lanan arabuluculuk \u00fccreti, yarg\u0131lama giderlerinden say\u0131l\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(15) As\u0131l i\u015fveren-alt i\u015fveren ili\u015fkisinin varl\u0131\u011f\u0131 h\u00e2linde i\u015fe iade talebiyle arabulucuya ba\u015fvuruldu\u011funda, anla\u015fman\u0131n ger\u00e7ekle\u015febilmesi i\u00e7in i\u015fverenlerin arabuluculuk g\u00f6r\u00fc\u015fmelerine birlikte kat\u0131lmalar\u0131 ve iradelerinin birbirine uygun olmas\u0131 aran\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(16) Bu madde uyar\u0131nca arabuluculuk b\u00fcrosu taraf\u0131ndan yap\u0131lmas\u0131 gereken zaruri giderler; arabuluculuk faaliyeti sonunda anla\u015fmaya var\u0131lmas\u0131 h\u00e2linde anla\u015fma uyar\u0131nca taraflarca \u00f6denmek, anla\u015fmaya var\u0131lamamas\u0131 h\u00e2linde ise ileride haks\u0131z \u00e7\u0131kacak taraftan tahsil olunmak \u00fczere Adalet Bakanl\u0131\u011f\u0131 b\u00fct\u00e7esinden kar\u015f\u0131lan\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Arabuluculuk S\u00fcreci Ne Kadar S\u00fcrer?<\/strong><br>Arabuluculuk s\u00fcreci arabulucu taraf\u0131ndan yap\u0131lan ba\u015fvuruyu g\u00f6revlendirildi\u011fi tarihten itibaren \u00fc\u00e7 hafta i\u00e7inde sonu\u00e7land\u0131r\u0131r. Bu nedenle i\u015f mahkemelerinde g\u00f6r\u00fclen davalarda tan\u0131k delilinin olmas\u0131 davan\u0131n sonucu a\u00e7\u0131s\u0131ndan etkili bir delildir fakat tan\u0131k olmamas\u0131 halinde de dava a\u00e7\u0131lmas\u0131nda bir engel olmamakla birlikte dava da talep edilen tazminatlar\u0131n ba\u015fka deliller ile ispat edilmesi gerekmektedir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u0130\u015ften \u00c7\u0131kar\u0131lan \u0130\u015f\u00e7i Ne Kadar S\u00fcrede Dava A\u00e7abilir?<\/strong><br>\u0130\u015ften \u00e7\u0131kar\u0131lan i\u015f\u00e7i i\u015fe iade davas\u0131 a\u00e7mak istiyorsa i\u015ften \u00e7\u0131kar\u0131ld\u0131\u011f\u0131 tarihten itibaren , fesih bildirimi yap\u0131lm\u0131\u015f ise fesih bildiriminden itibaren 1 ay i\u00e7erisinde i\u015fe iade talebi ile arabuluculuk yoluna ba\u015fvurmu\u015f olmas\u0131 gerekmektedir. Arabuluculukta son oturum tutana\u011f\u0131n\u0131n d\u00fczenlendi\u011fi tarihten 2 hafta i\u00e7erisinde i\u015fe iade davas\u0131 a\u00e7mas\u0131 gerekmektedir bu s\u00fcreler hak d\u00fc\u015f\u00fcr\u00fcc\u00fc s\u00fcreler olup bu s\u00fcrelerin ka\u00e7\u0131r\u0131lmas\u0131 halinde dava usulden reddedilecektir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00dccret alacaklar\u0131nda, \u0130\u015f s\u00f6zle\u015fmesinden kaynaklanmak kayd\u0131yla hangi kanuna tabi olursa olsun, y\u0131ll\u0131k izin \u00fccreti K\u0131dem tazminat\u0131, \u0130\u015f s\u00f6zle\u015fmesinin bildirim \u015fart\u0131na uyulmaks\u0131z\u0131n feshinden kaynaklanan tazminat, K\u00f6t\u00fc niyet tazminat\u0131, \u0130\u015f s\u00f6zle\u015fmesinin e\u015fit davranma ilkesine uyulmaks\u0131z\u0131n feshinden kaynaklanan tazminat zamana\u015f\u0131m\u0131 s\u00fcresi be\u015f y\u0131ld\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Haks\u0131z Yere \u0130\u015ften \u00c7\u0131kar\u0131lan \u0130\u015f\u00e7i Ne Yapmal\u0131?<\/strong><br>Haks\u0131z yere i\u015ften \u00e7\u0131kar\u0131lan veya haks\u0131z yere i\u015ften \u00e7\u0131kar\u0131ld\u0131\u011f\u0131n\u0131 d\u00fc\u015f\u00fcnen i\u015f\u00e7i i\u015fe iade davas\u0131 a\u00e7arak hakl\u0131 ve ge\u00e7erli nedene dayanmadan i\u015ften \u00e7\u0131kar\u0131lmas\u0131 nedeni ile i\u015f g\u00fcvencesi kapsam\u0131nda i\u015fe iadesini i\u015f mahkemesinde dava a\u00e7arak talep edebilir dava kesinle\u015ftikten sonra i\u015f\u00e7i taraf\u0131ndan i\u015fverene ihtarname g\u00f6nderilerek i\u015fe ba\u015flamaya haz\u0131r oldu\u011funu bildirir i\u015fveren bu ihtardan sonra i\u015f\u00e7iyi 30 g\u00fcn i\u00e7erisinde i\u015fe davet etmezse mahkemece belirlenen i\u015fe ba\u015flatmama tazminat\u0131n\u0131 i\u015f\u00e7iye \u00f6demesi gerekmektedir. \u0130\u015fveren i\u015f\u00e7iyi i\u015fe davet eder i\u015f\u00e7i de bu davet \u00fczerine i\u015fe ba\u015flarsa i\u015fveren i\u015fe ba\u015flatmama tazminat\u0131ndan sorumlu olmaz bir tek bo\u015fta ge\u00e7en s\u00fcre \u00fccretinden sorumlu olur. \u0130\u015fveren i\u015f\u00e7iyi i\u015fe davet etmesine ra\u011fmen i\u015f\u00e7i makul s\u00fcre i\u00e7erisinde i\u015fe ba\u015flamazsa art\u0131k i\u015fverenin i\u015fe ba\u015flatmama ve bo\u015fta ge\u00e7en s\u00fcre \u00fccreti y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc bulunmamaktad\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u0130\u015ften \u00c7\u0131kard\u0131lar Ne Yapmam Laz\u0131m?<\/strong><br>\u0130\u015f\u00e7inin i\u015ften \u00e7\u0131kar\u0131lmas\u0131 halinde \u00f6ncelikle i\u015ften \u00e7\u0131kar\u0131lma sebebine g\u00f6re hareket etmesi gerekmektedir. \u0130\u015f\u00e7i hakl\u0131 veya ge\u00e7erli nedene dayanmadan i\u015ften \u00e7\u0131kart\u0131lm\u0131\u015f ise i\u015fe iade davas\u0131 s\u00fcrecini ba\u015flatmal\u0131d\u0131r. \u0130\u015fe iade \u015fartlar\u0131 olu\u015fmamas\u0131 halinde i\u015ften \u00e7\u0131karma k\u00f6t\u00fc niyetle yap\u0131lm\u0131\u015f ise k\u00f6t\u00fc niyet tazminat davas\u0131 s\u00fcrecini ba\u015flatmal\u0131d\u0131r. \u0130\u015f\u00e7inin k\u0131dem tazminat\u0131, ihbar tazminat\u0131 , fazla mesai \u00fccreti, hafta tatili \u00fccreti, y\u0131ll\u0131k izin \u00fccreti , genel tatil \u00fccretinin i\u015fveren taraf\u0131ndan \u00f6denmemesi halinde bu davalar i\u015f\u00e7i taraf\u0131ndan a\u00e7\u0131lmal\u0131d\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0130\u015f\u00e7inin di\u011fer i\u015f\u00e7ilik alacaklar\u0131 ve tazminatlar\u0131 konusunda i\u015f hukuku avukat\u0131ndan dan\u0131\u015fmanl\u0131k alarak detayl\u0131 olarak haklar\u0131n\u0131 \u00f6\u011frenmesi ve bu do\u011frultuda hareket etmesi yarar\u0131na olacakt\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u0130\u015ften \u00c7\u0131kar\u0131lan \u0130\u015f\u00e7i Tazminat Alabilir Mi?<\/strong><br>\u0130\u015ften hakl\u0131 nedene dayanmadan i\u015f akdinin i\u015fveren taraf\u0131ndan sonland\u0131r\u0131lmas\u0131 halinde i\u015f\u00e7inin k\u0131dem tazminat\u0131 hakk\u0131 do\u011fmaktad\u0131r ayr\u0131ca i\u015fveren taraf\u0131ndan i\u015f\u00e7i bildirim s\u00fcresine uyulmaks\u0131z\u0131n i\u015ften \u00e7\u0131kar\u0131lmas\u0131 halinde k\u0131dem tazminat\u0131 yan\u0131nda ihbar tazminat\u0131 hakk\u0131 da do\u011fmaktad\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0130\u015fveren taraf\u0131ndan i\u015f\u00e7inin hakl\u0131 nedenle i\u015ften \u00e7\u0131kar\u0131lmas\u0131 halinde i\u015f\u00e7inin k\u0131dem tazminat\u0131 hakk\u0131 do\u011fmayacakt\u0131r. \u0130\u015fveren taraf\u0131ndan hakl\u0131 nedenle fesih halleri 4857 say\u0131l\u0131 i\u015f kanunun 25. Maddesinde d\u00fczenlenmi\u015f olup bu haller;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Madde 25: S\u00fcresi belirli olsun veya olmas\u0131n i\u015fveren, a\u015fa\u011f\u0131da yaz\u0131l\u0131 hallerde i\u015f s\u00f6zle\u015fmesini s\u00fcrenin bitiminden \u00f6nce veya bildirim s\u00fcresini beklemeksizin feshedebilir:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><mark style=\"background-color:#8b1919\" class=\"has-inline-color has-cyan-bluish-gray-color\">I- Sa\u011fl\u0131k Sebepleri:<\/mark><br>a) \u0130\u015f\u00e7inin kendi kast\u0131ndan veya derli toplu olmayan ya\u015fay\u0131\u015f\u0131ndan yahut i\u00e7kiye d\u00fc\u015fk\u00fcnl\u00fc\u011f\u00fcnden do\u011facak bir hastal\u0131\u011fa veya sakatl\u0131\u011fa u\u011framas\u0131 halinde, bu sebeple do\u011facak devams\u0131zl\u0131\u011f\u0131n ard\u0131 ard\u0131na \u00fc\u00e7 i\u015f g\u00fcn\u00fc veya bir ayda be\u015f i\u015f g\u00fcn\u00fcnden fazla s\u00fcrmesi.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">b) \u0130\u015f\u00e7inin tutuldu\u011fu hastal\u0131\u011f\u0131n tedavi edilemeyecek nitelikte oldu\u011fu ve i\u015fyerinde \u00e7al\u0131\u015fmas\u0131nda sak\u0131nca bulundu\u011funun Sa\u011fl\u0131k Kurulunca saptanmas\u0131 durumunda.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(a) alt bendinde say\u0131lan sebepler d\u0131\u015f\u0131nda i\u015f\u00e7inin hastal\u0131k, kaza, do\u011fum ve gebelik gibi hallerde i\u015fveren i\u00e7in i\u015f s\u00f6zle\u015fmesini bildirimsiz fesih hakk\u0131; belirtilen hallerin i\u015f\u00e7inin i\u015fyerindeki \u00e7al\u0131\u015fma s\u00fcresine g\u00f6re 17 nci maddedeki bildirim s\u00fcrelerini alt\u0131 hafta a\u015fmas\u0131ndan sonra do\u011far. Do\u011fum ve gebelik hallerinde bu s\u00fcre 74 \u00fcnc\u00fc maddedeki s\u00fcrenin bitiminde ba\u015flar. Ancak i\u015f\u00e7inin i\u015f s\u00f6zle\u015fmesinin ask\u0131da kalmas\u0131 nedeniyle i\u015fine gidemedi\u011fi s\u00fcreler i\u00e7in \u00fccret i\u015flemez.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><mark style=\"background-color:rgba(0, 0, 0, 0);color:#672929\" class=\"has-inline-color\">II- Ahlak ve \u0130yi Niyet Kurallar\u0131na Uymayan Haller ve Benzerleri:<br><\/mark>a) \u0130\u015f s\u00f6zle\u015fmesi yap\u0131ld\u0131\u011f\u0131 s\u0131rada bu s\u00f6zle\u015fmenin esasl\u0131 noktalar\u0131ndan biri i\u00e7in gerekli vas\u0131flar veya \u015fartlar kendisinde bulunmad\u0131\u011f\u0131 halde bunlar\u0131n kendisinde bulundu\u011funu ileri s\u00fcrerek, yahut ger\u00e7e\u011fe uygun olmayan bilgiler veya s\u00f6zler s\u00f6yleyerek i\u015f\u00e7inin i\u015fvereni yan\u0131ltmas\u0131.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">b) \u0130\u015f\u00e7inin, i\u015fveren yahut bunlar\u0131n aile \u00fcyelerinden birinin \u015feref ve namusuna dokunacak s\u00f6zler sarf etmesi veya davran\u0131\u015flarda bulunmas\u0131 yahut i\u015fveren hakk\u0131nda \u015feref ve haysiyet k\u0131r\u0131c\u0131 as\u0131ls\u0131z ihbar ve isnadlarda bulunmas\u0131.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">c) \u0130\u015f\u00e7inin i\u015fverenin ba\u015fka bir i\u015f\u00e7isine cinsel tacizde bulunmas\u0131.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">d) \u0130\u015f\u00e7inin i\u015fverene yahut onun ailesi \u00fcyelerinden birine yahut i\u015fverenin ba\u015fka i\u015f\u00e7isine sata\u015fmas\u0131 veya 84 \u00fcnc\u00fc maddeye ayk\u0131r\u0131 hareket etmesi.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">e) \u0130\u015f\u00e7inin, i\u015fverenin g\u00fcvenini k\u00f6t\u00fcye kullanmak, h\u0131rs\u0131zl\u0131k yapmak, i\u015fverenin meslek s\u0131rlar\u0131n\u0131 ortaya atmak gibi do\u011fruluk ve ba\u011fl\u0131l\u0131\u011fa uymayan davran\u0131\u015flarda bulunmas\u0131.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">f) \u0130\u015f\u00e7inin, i\u015fyerinde, yedi g\u00fcnden fazla hapisle cezaland\u0131r\u0131lan ve cezas\u0131 ertelenmeyen bir su\u00e7 i\u015flemesi.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">g) \u0130\u015f\u00e7inin i\u015fverenden izin almaks\u0131z\u0131n veya hakl\u0131 bir sebebe dayanmaks\u0131z\u0131n ard\u0131 ard\u0131na iki i\u015fg\u00fcn\u00fc veya bir ay i\u00e7inde iki defa herhangi bir tatil g\u00fcn\u00fcnden sonraki i\u015f g\u00fcn\u00fc, yahut bir ayda \u00fc\u00e7 i\u015fg\u00fcn\u00fc i\u015fine devam etmemesi.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">h) \u0130\u015f\u00e7inin yapmakla \u00f6devli bulundu\u011fu g\u00f6revleri kendisine hat\u0131rlat\u0131ld\u0131\u011f\u0131 halde yapmamakta \u0131srar etmesi.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0131) \u0130\u015f\u00e7inin kendi iste\u011fi veya savsamas\u0131 y\u00fcz\u00fcnden i\u015fin g\u00fcvenli\u011fini tehlikeye d\u00fc\u015f\u00fcrmesi, i\u015fyerinin mal\u0131 olan veya mal\u0131 olmay\u0131p da eli alt\u0131nda bulunan makineleri, tesisat\u0131 veya ba\u015fka e\u015fya ve maddeleri otuz g\u00fcnl\u00fck \u00fccretinin tutar\u0131yla \u00f6deyemeyecek derecede hasara ve kayba u\u011fratmas\u0131.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">III- Zorlay\u0131c\u0131 Sebepler:<br>a) \u0130\u015f\u00e7iyi i\u015fyerinde bir haftadan fazla s\u00fcre ile \u00e7al\u0131\u015fmaktan al\u0131koyan zorlay\u0131c\u0131 bir sebebin ortaya \u00e7\u0131kmas\u0131.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">IV- \u0130\u015f\u00e7inin G\u00f6zalt\u0131na Al\u0131nmas\u0131 veya Tutuklanmas\u0131 Halinde Devams\u0131zl\u0131\u011f\u0131n 17. Maddedeki Bildirim S\u00fcresini A\u015fmas\u0131<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0130\u015f\u00e7i feshin yukar\u0131daki bentlerde \u00f6ng\u00f6r\u00fclen sebeplere uygun olmad\u0131\u011f\u0131 iddias\u0131 ile 18, 20 ve 21 inci madde h\u00fck\u00fcmleri \u00e7er\u00e7evesinde yarg\u0131 yoluna ba\u015fvurabilir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u015eeklinde olup i\u015fveren taraf\u0131ndan hakl\u0131 neden bulunmamas\u0131na ra\u011fmen i\u015f\u00e7inin i\u015f aksi hakl\u0131 nedenle feshedilirse i\u015f\u00e7i bu durumda feshin hakl\u0131 neden sebebi olu\u015fturmad\u0131\u011f\u0131 gerek\u00e7esi ile dava a\u00e7abilecektir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0130\u015ften \u00c7\u0131kan \u0130\u015f\u00e7i Haklar\u0131 Nelerdir?<br>\u0130\u015f\u00e7i kendi iste\u011fi ile hi\u00e7bir nedene dayanmadan i\u015f akdini sonland\u0131rm\u0131\u015f ise i\u015fverenin bask\u0131s\u0131 olmaks\u0131z\u0131n istifa etmi\u015f ise k\u0131dem tazminat\u0131 hakk\u0131 bulunmamaktad\u0131r. Fakat i\u015f\u00e7i istifa etmi\u015f olsa dahi fazla mesai \u00fccreti, maa\u015f alaca\u011f\u0131, hafta tatili \u00fccreti, genel tatil \u00fccreti, y\u0131ll\u0131k izin \u00fccreti kendisine \u00f6denmelidir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0130\u015f\u00e7i Hangi Durumlarda \u0130\u015f S\u00f6zle\u015fmesini Feshedebilir?<br>\u0130\u015f\u00e7inin hakl\u0131 nedenle veya ge\u00e7erli nedenle i\u015f s\u00f6zle\u015fmesini feshetmesi halinde k\u0131dem tazminat\u0131na hak kazanabilmektedir. \u0130\u015f\u00e7inin hakl\u0131 nedenle i\u015ften ayr\u0131labilece\u011fi haller 4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 24. Maddesinde d\u00fczenlenmi\u015ftir buna g\u00f6re i\u015f\u00e7inin i\u015f s\u00f6zle\u015fmesini hakl\u0131 nedenle feshedebilece\u011fi haller \u015fu \u015fekildedir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Madde 24: S\u00fcresi belirli olsun veya olmas\u0131n i\u015f\u00e7i, a\u015fa\u011f\u0131da yaz\u0131l\u0131 hallerde i\u015f s\u00f6zle\u015fmesini s\u00fcrenin bitiminden \u00f6nce veya bildirim s\u00fcresini beklemeksizin feshedebilir:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I. Sa\u011fl\u0131k Sebepleri:<br>a) \u0130\u015f s\u00f6zle\u015fmesinin konusu olan i\u015fin yap\u0131lmas\u0131 i\u015fin niteli\u011finden do\u011fan bir sebeple i\u015f\u00e7inin sa\u011fl\u0131\u011f\u0131 veya ya\u015fay\u0131\u015f\u0131 i\u00e7in tehlikeli olursa.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">b) \u0130\u015f\u00e7inin s\u00fcrekli olarak yak\u0131ndan ve do\u011frudan bulu\u015fup g\u00f6r\u00fc\u015ft\u00fc\u011f\u00fc i\u015fveren yahut ba\u015fka bir i\u015f\u00e7i bula\u015f\u0131c\u0131 veya i\u015f\u00e7inin i\u015fi ile ba\u011fda\u015fmayan bir hastal\u0131\u011fa tutulursa.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">II. Ahlak ve \u0130yi Niyet Kurallar\u0131na Uymayan Haller ve Benzerleri:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">a) \u0130\u015fveren i\u015f s\u00f6zle\u015fmesi yap\u0131ld\u0131\u011f\u0131 s\u0131rada bu s\u00f6zle\u015fmenin esasl\u0131 noktalar\u0131ndan biri hakk\u0131nda yanl\u0131\u015f vas\u0131flar veya \u015fartlar g\u00f6stermek yahut ger\u00e7e\u011fe uygun olmayan bilgiler vermek veya s\u00f6zler s\u00f6ylemek suretiyle i\u015f\u00e7iyi yan\u0131lt\u0131rsa.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">b) \u0130\u015fveren i\u015f\u00e7inin veya ailesi \u00fcyelerinden birinin \u015feref ve namusuna dokunacak \u015fekilde s\u00f6zler s\u00f6yler, davran\u0131\u015flarda bulunursa veya i\u015f\u00e7iye cinsel tacizde bulunursa.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">c) \u0130\u015fveren i\u015f\u00e7iye veya ailesi \u00fcyelerinden birine kar\u015f\u0131 sata\u015fmada bulunur veya g\u00f6zda\u011f\u0131 verirse, yahut i\u015f\u00e7iyi veya ailesi \u00fcyelerinden birini kanuna kar\u015f\u0131 davran\u0131\u015fa \u00f6zendirir, k\u0131\u015fk\u0131rt\u0131r, s\u00fcr\u00fckler, yahut i\u015f\u00e7iye ve ailesi \u00fcyelerinden birine kar\u015f\u0131 hapsi gerektiren bir su\u00e7 i\u015flerse yahut i\u015f\u00e7i hakk\u0131nda \u015feref ve haysiyet k\u0131r\u0131c\u0131 as\u0131ls\u0131z a\u011f\u0131r isnad veya ithamlarda bulunursa.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">d) \u0130\u015f\u00e7inin di\u011fer bir i\u015f\u00e7i veya \u00fc\u00e7\u00fcnc\u00fc ki\u015filer taraf\u0131ndan i\u015fyerinde cinsel tacize u\u011framas\u0131 ve bu durumu i\u015fverene bildirmesine ra\u011fmen gerekli \u00f6nlemler al\u0131nmazsa.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">e) \u0130\u015fveren taraf\u0131ndan i\u015f\u00e7inin \u00fccreti kanun h\u00fck\u00fcmleri veya s\u00f6zle\u015fme \u015fartlar\u0131na uygun olarak hesap edilmez veya \u00f6denmezse,<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">f) \u00dccretin par\u00e7a ba\u015f\u0131na veya i\u015f tutar\u0131 \u00fczerinden \u00f6denmesi kararla\u015ft\u0131r\u0131l\u0131p da i\u015fveren taraf\u0131ndan i\u015f\u00e7iye yapabilece\u011fi say\u0131 ve tutardan az i\u015f verildi\u011fi hallerde, aradaki \u00fccret fark\u0131 zaman esas\u0131na g\u00f6re \u00f6denerek i\u015f\u00e7inin eksik ald\u0131\u011f\u0131 \u00fccret kar\u015f\u0131lanmazsa yahut \u00e7al\u0131\u015fma \u015fartlar\u0131 uygulanmazsa.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">III. Zorlay\u0131c\u0131 Sebepler:<br>a) \u0130\u015f\u00e7inin \u00e7al\u0131\u015ft\u0131\u011f\u0131 i\u015fyerinde bir haftadan fazla s\u00fcre ile i\u015fin durmas\u0131n\u0131 gerektirecek zorlay\u0131c\u0131 sebepler ortaya \u00e7\u0131karsa.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u015eeklinde olup i\u015f\u00e7inin \u00e7al\u0131\u015ft\u0131\u011f\u0131 i\u015f yerinde hakl\u0131 nedenle fesih halleri meydana gelirse i\u015f\u00e7inin i\u015f s\u00f6zle\u015fmesini derhal feshetme hakk\u0131 vard\u0131r. \u0130\u015f\u00e7i taraf\u0131ndan derhal fesih s\u00f6zl\u00fc olarak da yap\u0131labilir fakat ispat kolayl\u0131\u011f\u0131 a\u00e7\u0131s\u0131ndan i\u015f\u00e7inin derhal fesihi noterden ihtarname ile g\u00f6ndermesini tavsiye etmekteyiz.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0130\u015f\u00e7i Savunma Vermezse Ne Olur?<br>4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 19. Feshin noterden ihtarname ile yap\u0131lmas\u0131 zorunlu olmay\u0131p ispat kolayl\u0131\u011f\u0131 a\u00e7\u0131s\u0131ndan feshin noter vas\u0131tas\u0131 ile yap\u0131lmas\u0131n\u0131 tavsiye ederiz.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0130\u015fverenin Fesih Hakk\u0131 Veren Ahlak Ve \u0130yi Niyet Kurallar\u0131na Uymayan Haller Nelerdir?<br>\u0130\u015f\u00e7inin ahlak ve iyi niyet kurallar\u0131na ayk\u0131r\u0131l\u0131k nedeni ile i\u015f\u00e7inin i\u015f s\u00f6zle\u015fmesini feshedebilece\u011fi haller \u0130\u015f Kanununda d\u00fczenlenmi\u015f olup bu haller ;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">II- Ahlak ve \u0130yi Niyet Kurallar\u0131na Uymayan Haller ve Benzerleri:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">a) \u0130\u015f bulunmas\u0131.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">c) \u0130\u015f\u00e7inin i\u015fverenin ba\u015fka bir i\u015f\u00e7isine cinsel tacizde bulunmas\u0131.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">d) \u0130\u015f\u00e7inin i\u015fverene yahut onun ailesi \u00fcyelerinden birine yahut i\u015fverenin ba\u015fka i\u015f\u00e7isine sata\u015fmas\u0131 veya 84 \u00fcnc\u00fc maddeye ayk\u0131r\u0131 hareket etmesi.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">e) \u0130\u015f\u00e7inin, i\u015fverenin g\u00fcvenini k\u00f6t\u00fcye kullanmak, h\u0131rs\u0131zl\u0131k yapmak, i\u015fverenin meslek s\u0131rlar\u0131n\u0131 ortaya atmak gibi do\u011fruluk ve ba\u011fl\u0131l\u0131\u011fa uymayan davran\u0131\u015flarda bulunmas\u0131.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">f) \u0130\u015f\u00e7inin, i\u015fyerinde, yedi g\u00fcnden fazla hapisle cezaland\u0131r\u0131lan ve cezas\u0131 ertelenmeyen bir su\u00e7 i\u015flemesi.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">g) \u0130\u015f\u00e7inin i\u015fverenden izin almaks\u0131z\u0131n veya hakl\u0131 bir sebebe dayanmaks\u0131z\u0131n ard\u0131 ard\u0131na iki i\u015fg\u00fcn\u00fc veya bir ay i\u00e7inde iki defa herhangi bir tatil g\u00fcn\u00fcnden sonraki i\u015f g\u00fcn\u00fc yahut bir ayda \u00fc\u00e7 i\u015fg\u00fcn\u00fc i\u015fine devam etmemesi.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">h) \u0130\u015f\u00e7inin yapmakla \u00f6devli bulundu\u011fu g\u00f6revleri kendisine hat\u0131rlat\u0131ld\u0131\u011f\u0131 halde yapmamakta \u0131srar etmesi.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0131) \u0130\u015f\u00e7inin kendi iste\u011fi veya savsamas\u0131 y\u00fcz\u00fcnden i\u015fin g\u00fcvenli\u011fini tehlikeye d\u00fc\u015f\u00fcrmesi, i\u015fyerinin mal\u0131 olan veya mal\u0131 olmay\u0131p da eli alt\u0131nda bulunan makineleri, tesisat\u0131 veya ba\u015fka e\u015fya ve maddeleri otuz g\u00fcnl\u00fck \u00fccretinin tutar\u0131yla \u00f6deyemeyecek derecede hasara ve kayba u\u011fratmas\u0131.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u015eeklinde i\u015f\u00e7i bu sebepler olu\u015fmad\u0131\u011f\u0131 halde i\u015fveren taraf\u0131ndan ahlak ve iyi niyet kurallar\u0131na ayk\u0131r\u0131l\u0131k nedeni ile i\u015ften \u00e7\u0131kart\u0131ld\u0131\u011f\u0131 iddias\u0131nda ise yarg\u0131 yoluna ba\u015fvurmal\u0131d\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">29 Maddeden \u0130\u015ften \u00c7\u0131kar\u0131lan \u0130\u015f\u00e7i Ne Yapmal\u0131?<br>\u0130\u015ften \u00e7\u0131k\u0131\u015f kodlar\u0131ndan biri olan kod 29, \u0130\u015fveren taraf\u0131ndan i\u015f\u00e7inin ahlak ve iyiniyet kurallar\u0131na ayk\u0131r\u0131 davran\u0131\u015f\u0131 nedeni ile fesih sebebini g\u00f6stermektedir. \u0130\u015f\u00e7inin i\u015ften \u00e7\u0131k\u0131\u015f bildirgesinde kod 29 yazmas\u0131 halinde i\u015fveren taraf\u0131ndan i\u015f\u00e7inin ahlak ve iyi niyet kurallar\u0131na ayk\u0131r\u0131 davran\u0131\u015f\u0131 nedeni ile i\u015ften \u00e7\u0131kar\u0131ld\u0131\u011f\u0131n\u0131 g\u00f6sterilmektedir. \u0130\u015f\u00e7i b\u00f6yle bir durumun olmad\u0131\u011f\u0131 d\u00fc\u015f\u00fcncesinde ise yarg\u0131 yoluna ba\u015fvurmal\u0131d\u0131r. \u0130\u015f\u00e7i a\u00e7aca\u011f\u0131 davada i\u015fveren feshin hakl\u0131 nedene dayand\u0131\u011f\u0131n\u0131 ispat edemezse dava sonunda i\u015fveren taraf\u0131ndan bildirilen 29 \u00e7\u0131k\u0131\u015f kodunu da Sosyal G\u00fcvenlik Kurumuna ba\u015fvurarak d\u00fczelttirebilecektir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Uygulamada i\u015f\u00e7inin ahlak ve iyi niyet kurallar\u0131na ayk\u0131r\u0131 davran\u0131\u015f\u0131 bulunmamas\u0131na ra\u011fmen i\u015fveren taraf\u0131ndan Kod 29 \u2018dan \u00e7\u0131k\u0131\u015f\u0131 yap\u0131labilmektedir bu durum i\u015f\u00e7inin i\u015fsizlik \u00f6dene\u011finden yararlanmas\u0131na engel oldu\u011fu gibi yeni bir i\u015f bulmas\u0131n\u0131 da zorla\u015ft\u0131rmaktad\u0131r bu gibi hallerde a\u00e7\u0131lacak i\u015f davas\u0131nda feshin hakl\u0131 nedenle yap\u0131ld\u0131\u011f\u0131n\u0131n ispat y\u00fck\u00fc i\u015fverene aittir i\u015fveren hakl\u0131 nedenle fesih yap\u0131ld\u0131\u011f\u0131n\u0131 ispat edemezse mahkemece feshin haks\u0131z fesih oldu\u011funa karar verilerektir i\u015f\u00e7i bu karardan sonra \u00e7\u0131k\u0131\u015f kodunu d\u00fczelttirebilece\u011fi gibi \u0130\u015eKUR\u2019a ba\u015fvurarak mahrum kald\u0131\u011f\u0131 i\u015fsizlik \u00f6dene\u011fini de alabilecektir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tazminats\u0131z \u0130\u015ften \u00c7\u0131karma Sebepleri Nelerdir?<br>\u0130\u015fveren taraf\u0131ndan \u0130\u015f\u00e7inin hakl\u0131 nedenle i\u015ften \u00e7\u0131kart\u0131ld\u0131\u011f\u0131 hallerde tazminat verme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc bulunmamaktad\u0131r. \u0130\u015fverenin Hakl\u0131 nedenle fesih halleri i\u015f kanunu 25. Maddesinde d\u00fczenlenmi\u015ftir. Bu haller<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I- Sa\u011fl\u0131k Sebepleri:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">a) \u0130\u015f\u00e7inin kendi kast\u0131ndan veya derli toplu olmayan ya\u015fay\u0131\u015f\u0131ndan yahut i\u00e7kiye d\u00fc\u015fk\u00fcnl\u00fc\u011f\u00fcnden do\u011facak bir hastal\u0131\u011fa veya sakatl\u0131\u011fa u\u011framas\u0131 halinde, bu sebeple do\u011facak devams\u0131zl\u0131\u011f\u0131n ard\u0131 ard\u0131na \u00fc\u00e7 i\u015f g\u00fcn\u00fc veya bir ayda be\u015f i\u015f g\u00fcn\u00fcnden fazla s\u00fcrmesi.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">b) \u0130\u015f\u00e7inin tutuldu\u011fu hastal\u0131\u011f\u0131n tedavi edilemeyecek nitelikte oldu\u011fu ve i\u015fyerinde \u00e7al\u0131\u015fmas\u0131nda sak\u0131nca bulundu\u011funun Sa\u011fl\u0131k Kurulunca saptanmas\u0131 durumunda.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(a) alt bendinde say\u0131lan sebepler d\u0131\u015f\u0131nda i\u015f\u00e7inin hastal\u0131k, kaza, do\u011fum ve gebelik gibi hallerde i\u015fveren i\u00e7in i\u015f s\u00f6zle\u015fmesini bildirimsiz fesih hakk\u0131; belirtilen hallerin i\u015f\u00e7inin i\u015fyerindeki \u00e7al\u0131\u015fma s\u00fcresine g\u00f6re 17. maddedeki bildirim s\u00fcrelerini alt\u0131 hafta a\u015fmas\u0131ndan sonra do\u011far. Do\u011fum ve gebelik hallerinde bu s\u00fcre 74 \u00fcnc\u00fc maddedeki s\u00fcrenin bitiminde ba\u015flar. Ancak i\u015f\u00e7inin i\u015f s\u00f6zle\u015fmesinin ask\u0131da kalmas\u0131 nedeniyle i\u015fine gidemedi\u011fi s\u00fcreler i\u00e7in \u00fccret i\u015flemez.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">II- Ahlak ve \u0130yi Niyet Kurallar\u0131na Uymayan Haller ve Benzerleri:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">a) \u0130\u015f s\u00f6zle\u015fmesi yap\u0131ld\u0131\u011f\u0131 s\u0131rada bu s\u00f6zle\u015fmenin esasl\u0131 noktalar\u0131ndan biri i\u00e7in gerekli vas\u0131flar veya \u015fartlar kendisinde bulunmad\u0131\u011f\u0131 halde bunlar\u0131n kendisinde bulundu\u011funu ileri s\u00fcrerek, yahut ger\u00e7e\u011fe uygun olmayan bilgiler veya s\u00f6zler s\u00f6yleyerek i\u015f\u00e7inin i\u015fvereni yan\u0131ltmas\u0131.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">b) \u0130\u015f\u00e7inin, i\u015fveren yahut bunlar\u0131n aile \u00fcyelerinden birinin \u015feref ve namusuna dokunacak s\u00f6zler sarfetmesi veya davran\u0131\u015flarda bulunmas\u0131 yahut i\u015fveren hakk\u0131nda \u015feref ve haysiyet k\u0131r\u0131c\u0131 as\u0131ls\u0131z ihbar ve isnadlarda bulunmas\u0131.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">c) \u0130\u015f\u00e7inin i\u015fverenin ba\u015fka bir i\u015f\u00e7isine cinsel tacizde bulunmas\u0131.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">d) \u0130\u015f\u00e7inin i\u015fverene yahut onun ailesi \u00fcyelerinden birine yahut i\u015fverenin ba\u015fka i\u015f\u00e7isine sata\u015fmas\u0131 veya 84 \u00fcnc\u00fc maddeye ayk\u0131r\u0131 hareket etmesi.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">e) \u0130\u015f\u00e7inin, i\u015fverenin g\u00fcvenini k\u00f6t\u00fcye kullanmak, h\u0131rs\u0131zl\u0131k yapmak, i\u015fverenin meslek s\u0131rlar\u0131n\u0131 ortaya atmak gibi do\u011fruluk ve ba\u011fl\u0131l\u0131\u011fa uymayan davran\u0131\u015flarda bulunmas\u0131.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">f) \u0130\u015f\u00e7inin, i\u015fyerinde, yedi g\u00fcnden fazla hapisle cezaland\u0131r\u0131lan ve cezas\u0131 ertelenmeyen bir su\u00e7 i\u015flemesi.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">g) \u0130\u015f\u00e7inin i\u015fverenden izin almaks\u0131z\u0131n veya hakl\u0131 bir sebebe dayanmaks\u0131z\u0131n ard\u0131 ard\u0131na iki i\u015fg\u00fcn\u00fc veya bir ay i\u00e7inde iki defa herhangi bir tatil g\u00fcn\u00fcnden sonraki i\u015f g\u00fcn\u00fc yahut bir ayda \u00fc\u00e7 i\u015fg\u00fcn\u00fc i\u015fine devam etmemesi.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">h) \u0130\u015f\u00e7inin yapmakla \u00f6devli bulundu\u011fu g\u00f6revleri kendisine hat\u0131rlat\u0131ld\u0131\u011f\u0131 halde yapmamakta \u0131srar etmesi.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0131) \u0130\u015f\u00e7inin kendi iste\u011fi veya savsamas\u0131 y\u00fcz\u00fcnden i\u015fin g\u00fcvenli\u011fini tehlikeye d\u00fc\u015f\u00fcrmesi, i\u015fyerinin mal\u0131 olan veya mal\u0131 olmay\u0131p da eli alt\u0131nda bulunan makineleri, tesisat\u0131 veya ba\u015fka e\u015fya ve maddeleri otuz g\u00fcnl\u00fck \u00fccretinin tutar\u0131yla \u00f6deyemeyecek derecede hasara ve kayba u\u011fratmas\u0131.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">III- Zorlay\u0131c\u0131 Sebepler:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0130\u015f\u00e7iyi i\u015fyerinde bir haftadan fazla s\u00fcre ile \u00e7al\u0131\u015fmaktan al\u0131koyan zorlay\u0131c\u0131 bir sebebin ortaya \u00e7\u0131kmas\u0131.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">IV- \u0130\u015f\u00e7inin G\u00f6zalt\u0131na Al\u0131nmas\u0131 veya Tutuklanmas\u0131 Halinde Devams\u0131zl\u0131\u011f\u0131n 17.Maddedeki Bildirim S\u00fcresini A\u015fmas\u0131<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0130\u015f\u00e7i feshin yukar\u0131daki bentlerde \u00f6ng\u00f6r\u00fclen sebeplere uygun olmad\u0131\u011f\u0131 iddias\u0131 ile 18, 20 ve 21 inci madde h\u00fck\u00fcmleri \u00e7er\u00e7evesinde yarg\u0131 yoluna ba\u015fvurabilir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u015eeklinde olup i\u015fveren taraf\u0131ndan hakl\u0131 neden bulunmamas\u0131na ra\u011fmen i\u015f\u00e7inin i\u015f aksi hakl\u0131 nedenle feshedilirse i\u015f\u00e7i bu durumda feshin hakl\u0131 neden sebebi olu\u015fturmad\u0131\u011f\u0131 gerek\u00e7esi ile dava a\u00e7abilecektir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u0130\u015fveren Hangi Hallerde \u0130\u015f\u00e7iyi Tazminats\u0131z \u0130\u015ften \u00c7\u0131karma Hakk\u0131na Sahiptir?<\/strong><br>\u0130\u015fveren i\u015f\u00e7inin \u0130\u015f Kanunun 25. Maddesinde yer alan durumlar ger\u00e7ekle\u015fti\u011finde i\u015f\u00e7iyi tazminats\u0131z i\u015ften \u00e7\u0131kartma hakk\u0131na sahiptir bu haller i\u015f kanunu 25. Maddesinde yaz\u0131lm\u0131\u015ft\u0131r. Fakat feshin ger\u00e7ek nedeni bu sebeplere dayanmamas\u0131 halinde i\u015f\u00e7inin yarg\u0131 yoluna ba\u015fvurma hakk\u0131 vard\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u0130\u015f Kazas\u0131 Durumunda Yap\u0131lmas\u0131 Gereken \u0130\u015flemler Nelerdir?<\/strong><br>\u0130\u015f\u00e7i i\u015f kazas\u0131 ge\u00e7irdikten sonra i\u015fveren taraf\u0131ndan Sosyal G\u00fcvenlik Kurumuna \u00fc\u00e7 i\u015f g\u00fcn\u00fc i\u015f kazas\u0131 bildirimi yapmas\u0131 gerekmektedir. \u0130\u015fverenin i\u015f kazas\u0131 bildirimini yapmamas\u0131 halinde idari para cezas\u0131 uygulanmaktad\u0131r. \u0130\u015fveren taraf\u0131ndan i\u015f kazas\u0131 bildirimi yap\u0131lmamas\u0131 halinde i\u015f\u00e7i taraf\u0131ndan da i\u015f kazas\u0131 bildirimi yap\u0131labilmektedir. \u0130\u015f kazas\u0131 bildirimi yap\u0131ld\u0131ktan sonra SGK taraf\u0131ndan g\u00f6revlendirilen m\u00fcfetti\u015f tahkikata ba\u015flar tahkikat sonucunda meydana gelen kazan\u0131n i\u015f kazas\u0131 olup olmad\u0131\u011f\u0131 tespiti yap\u0131l\u0131r. Kazan\u0131n i\u015f kazas\u0131 oldu\u011funa dair tespitin yap\u0131lmas\u0131ndan sonra m\u00fcfetti\u015f taraf\u0131ndan i\u015f yerinde gerekli incelemeler yap\u0131larak ve i\u015f yerinde \u00e7al\u0131\u015fan di\u011fer i\u015f\u00e7ilerin tan\u0131kl\u0131klar\u0131na ba\u015fvurarak meydana gelen i\u015f kazas\u0131nda i\u015f\u00e7i ve i\u015fverenin kusur oran\u0131n\u0131 belirler.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u0130\u015f Kazas\u0131 Oldu\u011funda \u0130lk \u00d6nce Ne Yap\u0131lmal\u0131?<\/strong><br>\u0130\u015f kazas\u0131 meydana gelmesi durumunda i\u015fveren taraf\u0131ndan \u00fc\u00e7 i\u015f g\u00fcn\u00fc i\u00e7inde i\u015f kazas\u0131 bildirimi yap\u0131lmal\u0131d\u0131r. \u0130\u015f kazas\u0131 ge\u00e7iren i\u015f\u00e7i i\u015f kazas\u0131 sonucu meslekte kazanma g\u00fcc\u00fc kayb\u0131 oran\u0131n\u0131n tespiti i\u00e7in Sosyal G\u00fcvenlik Kurumuna ba\u015fvuru yapar. Sosyal G\u00fcvenlik Kurumu Sa\u011fl\u0131k Kurulunca i\u015f kazas\u0131 ge\u00e7iren sigortal\u0131n\u0131n Meslekte kazanma g\u00fcc\u00fc kayb\u0131 oran\u0131 belirlenir. \u0130\u015f\u00e7inin bu orana itiraz etmesi halinde itiraz Y\u00fcksek Sa\u011fl\u0131k Kurulu taraf\u0131ndan incelenir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u0130\u015f Kazas\u0131 Ge\u00e7iren \u0130\u015f\u00e7inin Haklar\u0131 Nelerdir?<\/strong><br>\u0130\u015f kazas\u0131 sonucu olu\u015fan hastal\u0131k ve \u00f6z\u00fcrler nedeniyle Kurumca yetkilendirilen sa\u011fl\u0131k hizmeti sunucular\u0131n\u0131n sa\u011fl\u0131k kurullar\u0131 taraf\u0131ndan verilen raporlara istinaden Kurum Sa\u011fl\u0131k Kurulunca meslekte kazanma g\u00fcc\u00fc en az % 10 oran\u0131nda azalm\u0131\u015f bulundu\u011fu tespit edilen sigortal\u0131, s\u00fcrekli i\u015f g\u00f6remezlik gelirine hak kazan\u0131r. \u0130\u015f\u00e7inin \u0130\u015f kazas\u0131 nedeni i\u015fverenin kusurunun bulunmas\u0131 halinde maddi manevi tazminat davas\u0131 a\u00e7ma hakk\u0131 bulunmaktad\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u0130\u015f Kazas\u0131 \u0130\u015fveren Ne Yapmal\u0131?<\/strong><br>\u0130\u015f kazas\u0131 meydana geldi\u011finde i\u015fveren kolluk kuvvetlerine derhal Sosyal G\u00fcvenlik Kurumu\u2019na en ge\u00e7 \u00fc\u00e7 i\u015f g\u00fcn\u00fc i\u00e7inde i\u015f kazas\u0131 bildirimi yapmal\u0131d\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>I\u015f Kazas\u0131nda \u00d6l\u00fcm Olursa Ne Olur?<\/strong><br>Sosyal G\u00fcvenlik kurumu taraf\u0131ndan sa\u011flanan haklar Sosyal G\u00fcvenlik Kurumu taraf\u0131ndan \u0130\u015f kazas\u0131 nedeni ile \u00f6l\u00fcm meydana gelmi\u015f ise i\u015f kazas\u0131nda vefat eden i\u015f\u00e7inin hak sahiplerine Sosyal G\u00fcvenlik Kurumunca \u00f6l\u00fcm ayl\u0131\u011f\u0131 , cenaze \u00f6dene\u011fi, \u00d6l\u00fcm toptan \u00f6demesi, Ayl\u0131k almakta olan k\u0131z \u00e7ocuklar\u0131na evlenme \u00f6dene\u011fi verilmesi \u015feklindedir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u00d6l\u00fcml\u00fc \u0130\u015f Kazas\u0131nda Tazminat\u0131 Kim \u00d6der?<\/strong><br>\u0130\u015f kazas\u0131 neticesinde vefat ger\u00e7ekle\u015fmi\u015fse vefat eden ki\u015finin yasal miras\u00e7\u0131lar\u0131 taraf\u0131ndan i\u015fverene kar\u015f\u0131 maddi manevi tazminat davas\u0131 a\u00e7\u0131labilmektedir. Mahkemece i\u015f kazas\u0131 neticesinde kusur oran\u0131na g\u00f6re karar verilecektir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u00d6l\u00fcml\u00fc \u0130\u015f Kazas\u0131 Tazminat Nas\u0131l Hesaplan\u0131r?<\/strong><br>\u0130\u015f\u00e7inin i\u015f kazas\u0131 sonucu vefat etmesi halinde hak sahipleri taraf\u0131ndan i\u015fverene kar\u015f\u0131 a\u00e7\u0131lacak maddi tazminat davas\u0131nda i\u015f\u00e7inin ger\u00e7ek \u00fccreti \u00fczerinden tazminat hesab\u0131 yap\u0131lacakt\u0131r. Tazminat hesaplan\u0131rken i\u015f\u00e7inin ald\u0131\u011f\u0131 ger\u00e7ek \u00fccret, i\u015f\u00e7inin ya\u015f\u0131, taraflar\u0131n kusur oranlar\u0131 ve Sosyal Sigortalar taraf\u0131ndan ba\u011flanan pe\u015fin sermaye de\u011feri tam olarak belirlenerek hesaplama yap\u0131lacakt\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0130\u015f\u00e7inin i\u015f kazas\u0131 sonucu vefat etmesi halinde hak sahipleri taraf\u0131ndan i\u015fverene kar\u015f\u0131 a\u00e7\u0131lacak manevi tazminat davas\u0131nda manevi tazminat miktar\u0131 taraflar\u0131n kusur durumu , olay\u0131n a\u011f\u0131rl\u0131\u011f\u0131, paran\u0131n al\u0131m g\u00fcc\u00fc gibi bir \u00e7ok unsur dikkate mahkemece belirlenecektir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Yarg\u0131tay 21. Hukuk Dairesi\u2019nin i\u015f kazas\u0131 nedeni ile maddi manevi tazminat davas\u0131 ile ilgili 2016\/18916 E. \u2013 2018\/6873 K. Say\u0131l\u0131 ilam\u0131 \u201d \u0130\u015f kazas\u0131 sonucu destek tazminat\u0131n\u0131n hesaplanmas\u0131nda, ger\u00e7ek \u00fccretin esas al\u0131nmas\u0131 ko\u015fuldur. \u00c7al\u0131\u015fma ya\u015fam\u0131nda daha az vergi ya da sigorta pirimi \u00f6denmesi amac\u0131yla zaman zaman i\u015f s\u00f6zle\u015fmesi veya \u00fccret bordrolar\u0131nda g\u00f6sterilen \u00fccretlerin ger\u00e7e\u011fi yans\u0131tmad\u0131\u011f\u0131 g\u00f6r\u00fclmektedir. \u00d6te yandan, ger\u00e7ek \u00fccretin ise; i\u015f\u00e7inin k\u0131demi ve yapt\u0131\u011f\u0131 i\u015fin \u00f6zelli\u011fi ve niteli\u011fine g\u00f6re i\u015f\u00e7iye \u00f6denmesi gereken \u00fccret oldu\u011fu, i\u015fyeri veya sigorta kay\u0131tlar\u0131na ge\u00e7mi\u015f \u00fccret olmad\u0131\u011f\u0131 Yarg\u0131tay\u2019\u0131n yerle\u015fmi\u015f g\u00f6r\u00fc\u015flerindendir. Bu durumda ger\u00e7ek \u00fccretin tespiti \u00f6nem kazan\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Somut olayda, hakkaniyete uygun maddi tazminat\u0131n tespiti a\u00e7\u0131s\u0131ndan, \u00f6ncelikle imzal\u0131 maa\u015f bordrolar\u0131n\u0131n i\u015fveren taraf\u0131ndan ibraz\u0131, bu belgelerin bulunmamas\u0131 halinde ise sigortal\u0131n\u0131n olay tarihinde yapt\u0131\u011f\u0131 i\u015fe g\u00f6re meslek odalar\u0131ndan \u00fccret ara\u015ft\u0131rmas\u0131 yap\u0131lmas\u0131 gerekirken; asgari \u00fccret \u00fczerinden yap\u0131lan hesab\u0131n h\u00fckme esas al\u0131nmas\u0131 da hatal\u0131 olmu\u015ftur.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hakimin manevi zarar ad\u0131 ile \u00f6lenin yak\u0131nlar\u0131na verilmesine karar verece\u011fi para tutar\u0131 adalete uygun olmal\u0131d\u0131r. H\u00fckmedilecek bu para, zarara u\u011frayanda manevi huzuru do\u011furmay\u0131 ger\u00e7ekle\u015ftirecek tazminata benzer bir fonksiyonu olan \u00f6zg\u00fcn bir nitelik ta\u015f\u0131r. Bir ceza olmad\u0131\u011f\u0131 gibi, mamelek hukukuna ili\u015fkin zarar\u0131n kar\u015f\u0131lanmas\u0131n\u0131 da ama\u00e7 edinmemi\u015ftir. O halde, bu tazminat\u0131n s\u0131n\u0131r\u0131 onun amac\u0131na g\u00f6re belirlenmelidir. Takdir edilecek miktar, mevcut halde elde edilmek istenilen tatmin Duygusunun etkisine ula\u015fmak i\u00e7in gerekli olan kadar olmal\u0131d\u0131r. 26.06.1966 g\u00fcnl\u00fc ve 7\/7 say\u0131l\u0131 Yarg\u0131tay \u0130\u00e7tihad\u0131 Birle\u015ftirme Karar\u0131\u2019n\u0131n gerek\u00e7esinde takdir olunacak manevi tazminat\u0131n tutar\u0131n\u0131 etkileyecek \u00f6zel hal ve \u015fartlar da a\u00e7\u0131k\u00e7a g\u00f6sterilmi\u015ftir.
